Simon Cowell’s new boy band December 10, which was formed on his Netflix docuseries The Next Act, is facing a potential legal challenge over their name. There has reportedly been some confusion with another band called December Tenth.

Last week, the series Simon Cowell: The Next Act premiered on Netflix. The project documents the music mogul’s search for members of a new boy band. The seven-member group he ended up forming is named December 10 — which also happened to be the series’ premiere date.

The members of December 10 — Hendrik Christoffersen, Cruz Lee-Ojo, John Fadare, Nicolas Alves, Josh Oliver, Danny Bretherton, and Seán Hayden — have released a cover of “Bye Bye Bye” by NSYNC and accumulated over 100,000 Instagram followers as of this writing.

However, there has been some confusion over the band’s name, as it’s similar to a Scottish heavy metal band called December Tenth. According to The Mirror, December Tenth’s lead singer took to social media to address the similarity.

“It came to light over the last few days that Simon Cowell, Netflix and Universal Music, are involved in a new boy band that share, to some extent, our name December Tenth,” the post reportedly read. “Now if anyone in Simon’s team, Universal or Netflix, would like to get in touch with ourselves and our legal team they can do so. I would like to point out, the hundreds of new followers we have over the last few days are most welcome, but I’m not entirely sure they are all genuine.”

December Tenth Was Inundated with Messages

The band December Tenth shared that their “social media accounts have blown up” since The Next Act premiered, adding, “We are now being inundated with well wishes from fans of the show thinking we are that band.”

This is actually not the first time a group associated with Cowell has had an issue with their name. The girl group Little Mix, which was formed on The X Factor in 2011, was initially named Rhythmix. However, they faced legal action from a children’s charity with the same name and had to rebrand.

Fans have also pointed out that December 10’s abbreviated name, D10, is similar to 1D, which was the abbreviation for One Direction — another group formed on The X Factor. Was this intentional on Cowell’s part? Let us know what you think in the comments below.
